1. Acceptance of Terms
By accessing or using the services provided by Trivara Global (OPC) Private Limited ("Trivara", "we", "us", or "our"), including the website `trivaralogistics.com`, API integrations, dashboards, and automated courier modules, you agree to comply with and be bound by these Terms & Conditions.
If you do not agree to these terms, you are prohibited from utilizing our software systems and services.
2. User Registration & Accounts
To configure active courier integrations, merchants must register for an official client account:
- You must provide accurate, complete, and current registration information (including legal business registration, GSTIN, and identity details).
- You are solely responsible for maintaining the confidentiality of your API keys and client credentials.
- We reserve the right to suspend accounts that provide false details or engage in fraudulent shipping practices.
3. Wallet Billing & Payments
Trivara services operate on a pre-paid wallet balance model:
- Merchants must maintain a positive wallet balance to generate active shipping labels.
- Shipping charges are calculated based on weight sheets and volumetric dimensions. Any weight discrepancies reported by courier partners will result in automated wallet reconciliation adjustments.
- Failed deliveries resulting in Return-to-Origin (RTO) remain subject to standard RTO transport fees charged by the carrying courier.
4. Terms of Carriage & Shipping
Trivara acts as a logistics aggregator software partner. The actual carriage of parcels is handled by third-party transport companies (e.g. Blue Dart, Delhivery, Xpressbees):
- Merchants must not ship prohibited or hazardous materials (including explosives, flammable liquids, currency, or illegal narcotics) in violation of Indian Postal Rules.
- Parcel packaging is the sole responsibility of the merchant. Damages resulting from inadequate parcel packaging will not be eligible for courier liability claims.
5. Limitation of Liability
Trivara provides logistics aggregation software "as is". We do not guarantee delivery timeline accuracy or uninterrupted server uptime:
Under no circumstances shall Trivara Global (OPC) Private Limited be liable for any indirect, consequential, or special damages, lost business revenues, or courier transport failures. Liability for lost or damaged parcels is strictly capped in accordance with the terms of carriage declared by the respective courier handling the delivery.
6. Account Termination
We reserve the right to terminate or restrict access to your Trivara merchant dashboard at our sole discretion, without prior notice, for conduct that violates these Terms, Indian regulations, or compromises platform security.
7. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of India. Any legal disputes or claims arising out of the use of our services shall be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat.
